Store and Membership Terms of Use

These Terms of Use govern access to and use of digital products, paid content, and membership services offered by this store. By purchasing, subscribing, or using member features, a customer agrees to these terms.

1. Definitions

Store means the merchant-operated storefront and related checkout, delivery, and support channels.
Membership means recurring paid access to member-only benefits, content, discounts, community features, or other benefits described on the store page.
Digital Product means downloadable or accessible digital goods, including templates, files, media, guides, and software assets.
Customer means any individual or entity that places an order, subscribes, or uses services.
Account means a customer identity used to access purchases, licenses, and member-only features.

2. Eligibility and Account Responsibility

Customers must be legally capable of entering a binding agreement in their jurisdiction.
Customers are responsible for maintaining accurate account and billing information.
Customers must keep login credentials secure and are responsible for activity under their account, except where caused by store negligence or security incidents.
Customers must immediately report unauthorized account access.

3. Orders, Billing, and Taxes

All listed prices are shown in the currency stated at checkout and may exclude applicable taxes unless explicitly indicated.
Applicable taxes, fees, and final charge totals are calculated and displayed before order completion.
The store may use third-party payment processors. Payment card data is processed by those processors and is not intentionally stored in full by the store unless required for lawful billing operations.
The store may decline or cancel an order for suspected fraud, abuse, legal restrictions, pricing errors, inventory or service unavailability, or payment authorization failure.
Where required by law, invoices or transaction confirmations are provided electronically.

4. Membership Billing and Renewal

Membership fees are billed on the cadence disclosed at checkout, such as monthly or annually.
Membership renews automatically unless cancelled before the next renewal date.
If payment fails, the store may retry billing and may suspend or terminate member access until payment is resolved.
The store may change membership pricing for future billing cycles with advance notice as required by applicable law.
Cancellation takes effect at the end of the current paid period unless local law requires immediate pro-rata treatment.
No partial-period refunds are provided unless required by law or explicitly stated in a written refund policy.

5. Digital Delivery and Access

Digital products are delivered via account access, downloadable links, email, or other electronic delivery method described at checkout.
Delivery is deemed complete when product access is made available to the customer account or designated destination.
Customers are responsible for maintaining compatible hardware, software, and internet connectivity.
The store does not guarantee uninterrupted service and may conduct maintenance, updates, or migrations.

6. Licensing and Permitted Use

Unless otherwise specified, digital products are licensed, not sold.
Customers receive a non-exclusive, non-transferable, revocable license to use purchased products within the permitted scope described on product pages or accompanying license files.
Without prior written permission, customers may not:
resell, redistribute, sublicense, or share files;
remove ownership notices or attribution requirements;
reverse engineer protected components except where non-waivable legal rights apply;
use products in unlawful, deceptive, abusive, or rights-infringing ways.
If product-specific license terms conflict with this section, product-specific license terms control.

7. Prohibited Conduct

Customers may not use the store or membership services to:
engage in fraud, chargeback abuse, or payment manipulation;
attempt unauthorized access to systems, data, APIs, or other accounts;
distribute malware or harmful code;
violate applicable law, third-party rights, or platform policies.
The store may suspend access or terminate accounts for violations, with or without prior notice depending on risk and legal obligations.

8. User Content and Community Features

Where customer-generated content is permitted, customers retain ownership of their content.
Customers grant the store a limited, worldwide, royalty-free license to host, process, display, and transmit user content solely to operate, secure, and improve services.
Customers represent they have rights to submitted content and that content does not violate law or third-party rights.
The store may remove content that violates terms, law, or legitimate safety standards.

9. Refunds, Chargebacks, and Disputes

Refund eligibility is governed by the store refund policy and non-waivable local consumer rights.
Unauthorized or abusive chargebacks may result in temporary account suspension while evidence is reviewed.
Customers are encouraged to contact support before initiating payment disputes.
Nothing in these terms limits statutory rights available under applicable consumer law.

10. Intellectual Property

Store branding, site design, code, templates, copy, and product assets are protected by intellectual property laws.
No rights are granted except those expressly stated in these terms or in product-specific licenses.
Trademark, brand, and logo use requires prior written permission unless law permits otherwise.

11. Third-Party Services

The store may rely on third-party providers for payments, analytics, infrastructure, authentication, and communications.
The store is not responsible for third-party outages or policy changes beyond reasonable control.
Third-party terms may apply to customer use of integrated services.

12. Service Availability and Changes

The store may add, modify, or discontinue products, membership benefits, pricing, or features at any time.
Material adverse changes to active subscriptions will be communicated as required by law.
Legacy access terms may be preserved for a transition period at the store’s discretion unless legal obligations require immediate change.

13. Warranties and Disclaimers

Except where prohibited by law, products and services are provided on an as-is and as-available basis.
The store disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.
The store does not warrant that services will be uninterrupted, error-free, or fully secure.

14. Limitation of Liability

To the maximum extent permitted by law, the store is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, data loss, or business interruption.
Where liability cannot be excluded, total liability is limited to the amount paid by the customer to the store for the relevant product or membership during the 12 months preceding the event giving rise to the claim.
This limitation does not exclude liability for willful misconduct, gross negligence, personal injury, fraud, or other liabilities that cannot be limited by law.

15. Indemnification

Customers agree to indemnify and hold harmless the store operator and affiliates from claims, losses, and expenses arising from customer misuse, terms violations, or rights-infringing content, except to the extent caused by the store’s own unlawful conduct.

16. Suspension and Termination

The store may suspend or terminate account access for fraud risk, legal compliance, security threats, prolonged payment failure, or material terms violations.
Upon termination, active licenses and membership access may end immediately unless legal requirements or written store policy provide otherwise.
Certain provisions survive termination, including payment obligations, intellectual property protections, liability limitations, and dispute terms.

17. Governing Law and Venue

These terms are governed by the laws stated in the store legal settings or, if not specified, the laws of the operator’s principal place of business, excluding conflict-of-law rules where permitted.
Mandatory consumer protections in the customer’s residence jurisdiction remain unaffected.
Disputes may be brought in competent courts as required by law or as specified in the store legal settings.

18. Changes to These Terms

The store may revise these terms to reflect legal, operational, or product changes.
For material changes, notice is provided through site posting, account notification, or email where reasonably available.
Continued use after the effective date constitutes acceptance, except where explicit consent is required by law.

20. Language and Interpretation

If translated versions exist, the designated controlling language in the store legal settings prevails in case of conflict, unless prohibited by local law.
